Operating and safety rules of HUDY Boulder Karlín


We welcome all climbers and visitors who have decided to try our main bouldering climbing wall (hereinafter referred to as the “wall”) or the playground connected with the children’s bouldering wall (hereinafter referred to as the “children’s wall”). We believe that you will enjoy your stay with us and you will use our sports facilities for a long, safe and satisfied time. For this purpose, an operating code has been issued with safety rules of conduct valid for all visitors to the HUDY Boulder Karlín sports ground. Every new visitor is obliged to familiarize himself with the rules and safety on the wall and confirm their reading and observance in the system.

Service: the service is performed by a person authorised by the operator

Visitor: is a person who enters the wall or the children’s wall during the operation of the wall for the purpose of climbing or using the wall or the children’s wall premises and equipment for other chargeable activities, in particular for exercise, fitness or play.

1. Operating and safety regulations:

1. Parents are responsible for the movement and behaviour of children and adolescents throughout the premises. This also applies to the children’s wall, where parents have free access to supervise their children.

2. All visitors to the wall or children’s wall acknowledge that they are climbing at their own risk and responsibility and confirm that they are fully aware of all the dangers of this activity. All visitors acknowledge that climbing is only permitted by the operator to persons who have been duly informed of the operating rules of the sports ground.

3. Every visitor is obliged to assess his/her current health, physical capabilities, abilities and experience with climbing before starting sports activities on the wall or children’s wall. The operator does not recommend climbing the wall for pregnant women and people with health problems. The operator shall not be liable for injury to visitors’ health caused by overestimation of their own abilities, health or inattention.

4. Climbing is only allowed in climbing shoes and only on designated areas such as the climbing wall and the “Campus Board” (the Campus Board is a sloping board on which you can find a variety of different rails and holds to move up and down), which are equipped with a landing.

5. It is forbidden to enter or stay in the places of possible impact of a climbing person.

6. Every visitor is obliged to make sure that he/she will not endanger anyone by falling before starting his/her own climbing.

7. Every visitor is obliged to immediately report to the staff of the Huda Boulder Karlín (hereinafter referred to as “the staff”) any technical defects found on the wall or the children’s wall, including a loose hold or a damaged landing area, and to draw the attention of any other visitor who intends to enter the disturbed path to this fact.

8. Each visitor is obliged to behave in such a way as not to endanger or restrict other visitors, in the event of an accident, he/she is obliged to provide first aid to the injured person and to immediately call a doctor or an employee to summon him/her.

9. While climbing on the wall or the children’s wall, put away any unnecessary equipment that could endanger you or other visitors (especially rings, watches, keys, phone, etc.).

10. The employee shall have a first aid kit and shall record the accident in the accident book, including noting the details of any witnesses to the accident.

11. Do not leave objects in the landing area that may endanger the climber’s health in the event of a fall.

12. Climbing on the wall is only allowed for persons who have paid the entry fee and purchased a chip according to the valid price list before entering the paid zone. Each visitor must register and create an account, which is then assigned to the purchased chip.

13. Visitors are strictly forbidden to enter the wall and climb under the influence of alcohol or other addictive substances. In this context, the operator is entitled to refuse access to the wall or the children’s wall to a person who is obviously under the influence of alcohol or an addictive substance, or to expel such a person after discovering the fact.

14.Persons under 15 years of age may perform sports activities on the wall or children’s wall only under the direct supervision of their legal guardian or another person over 18 years of age who takes responsibility for them and confirms this fact to the operator by confirming it in the registration form and subsequent verification via SMS-code. The child’s legal guardian or the person who has assumed responsibility for the child is responsible for compliance with the safety rules and is responsible for their safety. The consent of the legal guardian must still be filled in and signed at the reception.

15. Every visitor over 15 years of age is obliged to familiarize himself with the operating rules. At the request of the operator, resp. persons authorised by him/her (employees), he/she is also obliged to prove his/her identity and age by presenting an identity document or other photo identification.

16.Persons over 15 years of age and under 18 years of age may perform sports activities on the wall independently only if they submit to the operator a written consent of a legal guardian, in which the legal guardian states that he/she agrees to the independent performance of sports activities of his/her child on the wall and in the premises of the sports ground and that he/she assumes full responsibility for him/her. Otherwise, persons over 15 years of age and under 18 years of age may only perform sports activities on the wall when accompanied by a person over 18 years of age who takes responsibility for him/her and confirms this fact to the operator in the registration form and subsequent verification via SMS-code.

17. The operator is entitled to record and verify for its own use the consent of legal representatives to their children and persons for whom they are responsible to engage in climbing activities on the HUDY Boulder Karlín wall and the declaration of assumption of responsibility for a person under 18 years of age.

18. Course leaders are obliged to inform the employee or the operator before the start of the training on the wall.

19. All responsibility for the course participants is assumed by the course leaders. For safety reasons, one adult can be in charge of a maximum of 6 pre-school children and 10 children aged 6-15 years.

20. The course leader can only be a person over 18 years of age with the appropriate licence for running courses on an artificial wall, who has a contract for running climbing courses with the wall operator.

21. Every visitor is obliged to keep all areas of the wall clean and tidy. He/she is obliged to follow the fire prevention principles and to familiarize himself/herself with the Fire Alarm Directive posted in the bar or wall.

22. Smoking and the use of addictive substances are strictly prohibited in the climbing wall. Alcohol may only be consumed in the designated area.

23. Business activities in the premises of the wall are permitted only with the consent of the wall operator.

24. It is forbidden to bring dogs and other animals.

25. In case of damage or loss of the rented equipment, the operator charges the visitor the corresponding financial compensation for the damaged item.

26. The operator or an employee is entitled at any time to expel from the wall a person who violates the provisions of these operating rules, including safety rules, without the right to a refund of the paid admission fee. The operator reserves the right to refuse entry to a person who has repeatedly violated the operating regulations or safety rules on the wall or the children’s wall.

27. Visitors acknowledge and are advised that the wall area is monitored by industrial security cameras during operating hours. The reason for this is to check visitors’ compliance with the operating regulations and safety rules and to protect the safety of visitors and other persons. The operator guarantees that it will keep the footage from the industrial camera only for the necessary time allowed by law and will use it exclusively for its own purposes. The operator guarantees the protection of personal data and visitor data.

28.Visitors, by their electronic signature in the form of an SMS code sent to a predetermined telephone number, express their consent to the operator processing the personal data provided by them in accordance with Act No. 101/2000 Coll., on the protection of personal data, as amended, for the purpose specified by the operator for the period of time necessary to achieve this purpose.

29. The Operating Regulations are valid from 1.1. 2023 and is binding for all visitors.

30. The Operator reserves the right to change and update the Operating Rules at any time.

31. Confirmation of the familiarization with the operating rules of the wall and the children’s wall is also realized by signing the SMS code.

2. Payment terms

All services of the climbing wall are charged according to the valid price list: www.hudysteny.cz/boulderkarlin/ceník

Payment for services at the climbing wall HUDY Boulder Karlín, operated by Boulder Area s.r.o., is possible in the following ways:

● Cash at the reception. Can be used to pay for all services.

● By credit card via ComGate Payments, a.s. terminal at the reception. Can be used to pay for all services.

● By bank transfer. Payment by bank transfer can be made on the basis of an invoice.

● Through ComGate Payments, a.s. payment gateway. (Preferred option)

Credit

● To simplify payments and save time at the reception, we offer the possibility of topping up the credit, which can then be used to pay for entrances, rentals, lessons, refreshments at the bar and more.

● When the credit is deposited, it is possible to draw admission automatically without the need for repeated payments at the reception. When depositing the credit, the customer receives a discounted admission fee (see the current price list www.hudysteny.cz/boulderkarlin/ceník). The credit can be paid, among other things, through the payment gateway of ComGate Payments, a.s. This option can be found in your personal account created during registration under the name “Recharge by credit card”.

● The minimum amount of credit deposit in cash and by card is 1000,- CZK.

● There is no limit when paying through a payment gateway.

● The validity of the credit is limited to 24 months. The validity of the discount based on the amount of credit is 365 days, i.e. one year.

● Credit can only be used up. It cannot be redeemed!
● The operator reserves the right to make changes to the price list during the use of the accumulated credit. This means that by charging the credit, the customer agrees to accept future price changes by the operator.

4. Complaints Procedure

A customer may file a billing claim for a transfer payment within 30 days from the date the service was billed or the bill was delivered by email to info@hudyboulder.cz

Service quality complaints can be made by emailing info@hudyboulder.cz. This must be done within 3 days of the provision of the claimed service.

Complaints will be resolved without undue delay, no later than 30 days from the date of the complaint, unless the provider and the customer agree otherwise.

Essentials of a claim

A claim cannot be made if the customer has used the entire service without terminating it prematurely due to dissatisfaction (in the case of a one-time entry) or if the customer has used it regularly and claims the service after the end of use.

Information to the customer about the outcome of the complaint:

The customer will be contacted within the complaint period in writing or by e-mail about the outcome of the complaint procedure.

Refund of payment for the claimed service:

In the case of an accepted claim, the customer will be refunded the amount for the claimed service as follows.

1. By substituting the same or similar service on a different date. By mutual agreement.

2. Cash at the reception of the HUDY Boulder Karlín wall. The amount will be paid against written confirmation of receipt of the amount paid.

3. Transfer to the customer’s account.

5. Consent to the processing and use of personal data

The Operator declares that all personal data provided by the visitor is confidential and will be used only for the performance of the contract with the visitor and will not be otherwise disclosed, provided to a third party, etc., except in the case of payment related to the ordered services. Personal data provided by the visitor to the Operator for the purpose of fulfilling the order are collected, processed and stored in accordance with the applicable laws of the Czech Republic, in particular Act No. 101/2000 Coll., on the protection of personal data, as amended.

The visitor gives the operator his/her consent to the collection and processing of this personal data for the purpose of fulfilling the subject of the contract for the provision of services in the operator’s sports centre until the visitor expresses his/her disagreement with this processing in writing. Visitors have the right to access and correct their personal data, including other legal rights to such data.

The visitor gives his/her consent to the operator to use his/her e-mail address to send information of an operational nature (e.g. shutdown of a particular sports facility due to an accident) and to send information about events for clients held in the operator’s sports centre until the visitor expresses his/her disagreement with this processing in writing.
